These Terms of Service ("Terms") govern your access to and use of the HydroGlove online store operated by Caltrades Inc. ("HydroGlove," "we," "us," or "our") at www.thehydroglove.com and related Shopify checkout pages (the "Services"). By browsing, placing an order, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. About HydroGlove

2. Eligibility and accounts

You must be able to form a binding contract under applicable law to place an order. You are responsible for accurate account information and for keeping login credentials confidential.

3. Products and descriptions

We aim to describe products accurately (including thickness, case quantity, and materials). Images and packaging may change over time. Product availability may vary. HydroGlove gloves are intended for appropriate workplace and general-use applications described on each product page; they are not a substitute for specialized PPE required by regulation for a particular hazard unless expressly stated.

4. Orders, pricing, and payment

Prices are shown in U.S. dollars unless otherwise stated and may change without notice before you complete checkout. An order is an offer to buy; we may accept or decline it (for example due to stock, pricing error, fraud checks, or shipping restrictions). Payment is processed securely through Shopify and its payment partners. You agree to provide valid payment information.

5. Shipping and delivery

Shipping methods, timelines, and fees are described at checkout and on our Shipping & Returns page. Title and risk of loss pass according to the carrier terms once we hand off the package, except where mandatory law provides otherwise. Please verify your shipping address; we are not responsible for delays or loss caused by incorrect addresses you provide.

6. Returns and refunds

Return eligibility, time windows, and process are set out on our Shipping & Returns page. Opened or used disposable gloves generally cannot be returned for hygiene reasons unless defective or shipped in error. Contact us promptly if your order arrives damaged or incorrect.

7. Wholesale and large orders

Wholesale or volume pricing may be offered separately through our wholesale quote process. Those quotes may include additional terms that supplement these Terms.

8. Acceptable use

You agree not to misuse the Services, including attempting unauthorized access, interfering with site operation, scraping in a way that harms performance, or using the Services for unlawful purposes.

9. Intellectual property

HydroGlove names, logos, product imagery, and site content are owned by Caltrades Inc. or its licensors. You may not copy, modify, or use them for commercial purposes without our prior written permission, except for fair use or other rights allowed by law.

11. Disclaimers

THE SERVICES AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE NOT ALLOWED. NOTHING IN THESE TERMS LIMITS ANY NON-WAIVABLE CONSUMER RIGHTS THAT APPLY TO YOU.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CALTRADES INC. AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES OR AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCTS GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

13. Indemnity

You agree to indemnify and hold harmless Caltrades Inc. from claims arising out of your misuse of the Services, violation of these Terms, or violation of applicable law, to the extent permitted by law.

14. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your place of residence apply. Courts in California will have jurisdiction over disputes, subject to those mandatory protections.

15. Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use of the Services after posting constitutes acceptance of the updated Terms, except where applicable law requires additional notice or consent.
